MSWADA WA SHERIA YA MAFUTA NA GESI 2015

Siku za karibuni kuna miswada mitatu imepitishwa bungeni kwa hati ya dharura na kuleta taharuki ya kuwa ''nchi inauzwa', Serikali imeleta miswada mibovu, mafuta yetu na gesi zetu mafisadi wachache wanataka kunufaika peke yao na kelele nyingi sana.

Swali linalonijia, kwa nini ''hati ya dharura''? na kwa nini wapinzani wasusuie, na wafanye vurugu mswada usijadiliwe? kwa maoni yangu kuna mambo mawili matatu yamejitokeza.

Kwanza pengine huu mswada una maslahi binafsi na wanaoupitisha ndio manahawajatupa muda wa kuujadili, au Mheshimiwa Rais anataka akumbukwe kuwa yeye ndio aliyeleta mapinduzi haya yaliyomo kwenye mswada au haamini atakayemuachia kiti cha Urais kama atakubali mswada huu upitishwe kama ilivyokuwa kwa awamu zilizopita.

Lakini pia naamini kamwe Wapinzani wasingekubali kukaa chini kukubali kuujadili ule mswada na kuupitisha kwa sababu ndani ya mswada ule kuna majibu ya mambo mengi ambayo Wapinzani wanasema CCM wamefeli na wao wakiingia madarakani watafanya.

Kwa sababu serikali haikutaka kushirikisha wananchi, walichokifanya wapinzani kimeonekana ni kitendo cha kishujaa na uzalendo wa hali ya juu.

Najua wengi hamjapata muda wa kusoma Mswada wa Mafuta na Gesi, vifuatavyo ni baadhi ya vipengele vya mswada huo nimevikopi bila kuongeza neno ili muangalie kama mswada ni mzuri au mbaya na kwa nini uharaka wenye mashaka.

8.-(1) Tanzania Petroleum Development Corporation shall be the  National Oil Company and shall, in that respect, undertake Tanzania’s  commercial aspects of petroleum in the upstream, midstream and downstream operations and participating interests of the Government in the petroleum and natural gas agreements.

 (2) The Government shall at all times maintain a minimum of fifty one  percent of shares in the National Oil Company

 45.-(1) The petroleum operations rights shall be granted to the National Oil Company.

       (2) The National Oil Company shall have exclusive right over all  petroleum rights granted under this Part.

        (3) The licence granted to the National Oil Company shall not be transferable to any other person.

         (4) A company wishing to carry out petroleum operations in Tanzania outside the scope of a reconnaissance permit shall do so together with the  National Oil Company.

92.-(1) PURA may, with a written approval of the Minister, make available to the public-

 (a) details of all agreements, licences, permits and any amendments to the licences, permits     or agreements whether valid or terminated;

 (b)details of exemptions, variations or suspensions of conditions of licence and permit;

98. -(1) The licence holder and contractor shall have obligation to satisfy domestic market in Tanzania from their proportional share of production.

 99. The domestic natural gas price shall be determined based on the strategic nature of the project to be undertaken by the Government

 114.-(1) Subject to this Act, the licence holder and contractor shall pay royalty to the Government in respect of gross volume on petroleum recovered at the delivery point in a manner specified in the Second Schedule. (kwa mujibu wa jedwali lililopo nyuma ya sheria hii, serikali itapaswa kulipwa royalty ya asilimia 7.5 na 12.5)

(2) The agreement in respect to the grant of rights may include a  provision for payment of royalty in kind.

 149. All gas processing facilities shall be located onshore.

 220.-(1) A licence holder, contractors and subcontractors shall give  preference to goods which are produced or available in Tanzania and services which are rendered by Tanzanian citizens and or Local Companies.

(2) Where goods and services required by the contactor or licence holder are not available in Tanzania, such goods shall be provided by a company which has entered into a joint venture with a local company.

 221.-(1) A licence holder and a contractor shall, within twelve months after the grant of each licence, and on each subsequent anniversary of that grant, submit to PURA for approval, a detailed programme for recruitment and training of Tanzanians in accordance with an approved local content plan.

(2) The programme shall provide training and recruitment of Tanzanians in all phases of petroleum operations and gas activities and take into account gender, equity, persons with disabilities, host communities and succession plan in accordance with the Employment and Labour Relation Act.

 223.-(1) A licence holder and a contractor shall on annual basis, prepare a credible corporate social responsibility plan jointly agreed by the relevant local government authority or local government authorities.

USAFI WA ZITTO KABWE

Kuna kashfa inaenda na kujirudia kuwa Bwana Zitto Zuberi Kabwe (Mwanasiasa msafi kuliko wanasiasa wote kuwahi kutokea Tanzania)  ni moja ya watu walionufaika na mgao wa fedha za escrow, japo sijawahi msikia akitamka kwa ulimi wake kuwa hajapokea, ameishia kusema watu wachunguze, nitaendelea kuamini katika misingi ya mtu ni huru mpaka pale itakapothibitika kua ana makosa.

Lakini kwa kuwa vifaranga vimekuwa, na hana anayemuuguza, tunaomba sasa atujibu kwa ufasaha kwa kuwa maelezo yake ya awali yalijaa na uuguzi,  kuhusu mikataba wa leka Dutigite kwa upande mmoja na NSSF na TANAPA kwa upande mwengine

Kampuni ya Leka Dutigite ina wana hisa 16, 15 kati yao ni wasanii wa kizazi kipya wenye hisa asilimia 5 kila mmoja hivyo kuwa idadi ya asilimia 75 na asilimia 25 zilizobakia zinamilikiwa na Gombe advisors. Swali huyu Gombe ni nani?

Ukienda kuangalia makabrasha ya Brela Gombe advisors inamilikiwa na watu wawili, mtu mmoja mwenye jina la kikenya mwenye asilimia 25 na Bwana Zitto kabwe ambae kwenye fomu amejijaza kama mchumi badala ya kiongozi wa Umma

Kwa hiyo kumbe NSSF na TANAPA mashirika ya Umma ambayo yanakaguliwa yasifanye ufisadi na Bwana Zitto kabwe kwa mkono wa kulia, ukija mkono wa kushoto unakuta Bwana Zitto kabwe ndo mwanahisa mkuu kwenye mikataba ya kibiashara baina ya NSSF, TANAPA na leka dutigite, japo yeye anadai hakuna mgongano wa kimaslahi.

Katika tenda moja, NSSF iliilipa Leka Dutigite shilingi milioni 120, milioni 90 kati ya hizo zilitolewa siku moja baada ya kuwekwa, siku moja kabla ya uchaguzi wa kamati ya hesabu za mashirika ya umma PAC uliomfanya Bwana Zitto kuwa mwenyekiti wa kamati na kumng'oa mzee Cheyo aliyekuwa anafanya kazi kwa weledi mkubwa. Coincidence? ipo siku utawala utabadilika na hizi pesa zitamulikwa

Na ni bahati nzuri kuwa hizo pesa zilienda kutolewa na Habib Mchange, (bank statement inaeleza hivyo) aliyefukuzwa Chadema kwa kosa la kuwa kibaraka wa Zitto na kupanga mapinduzi ndani ya Chama, leo ndio katibu mkuu wa LekaDutigite kampuni ambayo Zitto anasema hana maslahi humo, kwa nini aweke watu wake?

Sasa hapa kuna maswali yanajitokeza

1. je NSSF na TANAPA ni mashirika ya Umma au hapana? Na je Zitto ni kiongozi wa Umma au Hapana

2. je Zitto anayakagua haya mashirika au hapana?

3. Je katiba ya jamhuri ya muungano wa Tanzania ya mwaka 1977 sura ya 6 sehemu ya 2 Na sheria ya utumishi wa Umma inamruhusu kiongozi kama yeye kuingia mkataba na mashirika ya Umma ukiachila mbali mashirika yanayoripoti chini yake?

4. Kama Gombe advisors si kampuni ya faida, kwa nini ijimilikishe hisa asilimia 25% Za Leka Dutigite? Je si ingekuwa sahihi ingebaki kuwa mshauri tu na wasanii wakagawana asilimia 100 ya kampuni ili wanapogawana faida wagawane kwa uwiano sawa kutokana na mgawanyo wa hisa zao

5. Kwa nini aweke watu wake wa karibu kuwa ndio viongozi wa Leka Dutigite kama yeye ni mdhamini tu na mshauri wa wanamuziki?

Mimi naamini hakuna ujanja ujanja unaodumu kwa muda mrefu nchi hii kabla haujagundulika, Chama Chake kimeshamjua, ipo siku hao anaowatumia kwenye ujanja ujanja wake watamgeuke na ukweli utawekwa hadharani. lakini hadi hapo yatakoapotokea hayo, bado nasubiri siku nione Zitto Kabwe akiikosoa NSSF na TANAPA kwa kuwa mpaka sasa kila akiongea mifano mema hutolea mashirika haya mawili. Mimi ndio yule yule niliyemtabiria kufukuzwa kwenye chama siku
aliyochaguliwa kuwa kiongozi wa chama.

My dear wife:

I am writing these words not knowing whether they will reach you, when they will reach you, and whether I shall still be alive when you read them. All through my struggle for the independence of my country, I have never doubted for a single instant the final triumph of the sacred cause to which my companions and I have devoted all our lives. But what we wished for our country, its right to an honourable life, to unstained dignity, to independence without restrictions, was never desired by the Belgian imperialists and the Western allies, who found direct and indirect support, both deliberate and unintentional, amongst certain high officials of the United Nations, that organization in which we placed all our trust when we called on its assistance.

They have corrupted some of our compatriots and bribed others. They have helped to distort the truth and bring our independence into dishonour. How could I speak otherwise?

Dead or alive, free or in prison by order of the imperialists, it is not myself who counts. It is the Congo, it is our poor people for whom independence has been transformed into a cage from whose confines the outside world looks on us, sometimes with kindly sympathy, but at other times with joy and pleasure. But my faith will remain unshakeable. I know and I feel in my heart that sooner or later my people will rid themselves of all their enemies, both internal and external, and that they will rise as one man to say No to the degradation and shame of colonialism, and regain their dignity in the clear light of the sun.

We are not alone. Africa, Asia and the free liberated people from all corners of the world will always be found at the side of the millions of Congolese who will not abandon the struggle until the day when there are no longer any colonialists and their mercenaries in our country. As to my children whom I leave and whom I may never see again, I should like them to be told that it is for them, as it is for every Congolese, to accomplish the sacred task of reconstructing our independence and our sovereignty: for without dignity there is no liberty, without justice there is no dignity, and without independence there are no free men.

Neither brutality, nor cruelty nor torture will ever bring me to ask for mercy, for I prefer to die with my head unbowed, my faith unshakable and with profound trust in the destiny of my country, rather than live under subjection and disregarding sacred principles. History will one day have its say, but it will not be the history that is taught in Brussels, Paris, Washington or in the United Nations, but the history which will be taught in the countries freed from imperialism and its puppets. Africa will write its own history, and to the north and south of the Sahara, it will be a glorious and dignified history.

Do not weep for me, my dear wife. I know that my country, which is suffering so much, will know how to defend its independence and its liberty.

Long live the Congo! Long live Africa!
