MSWADA WA SHERIA YA MAFUTA NA GESI 2015


Siku za karibuni kuna miswada mitatu imepitishwa bungeni kwa hati ya dharura na kuleta taharuki ya kuwa ''nchi inauzwa', Serikali imeleta miswada mibovu, mafuta yetu na gesi zetu mafisadi wachache wanataka kunufaika peke yao na kelele nyingi sana.

Swali linalonijia, kwa nini ''hati ya dharura''? na kwa nini wapinzani wasusuie, na wafanye vurugu mswada usijadiliwe? kwa maoni yangu kuna mambo mawili matatu yamejitokeza.

Kwanza pengine huu mswada una maslahi binafsi na wanaoupitisha ndio manahawajatupa muda wa kuujadili, au Mheshimiwa Rais anataka akumbukwe kuwa yeye ndio aliyeleta mapinduzi haya yaliyomo kwenye mswada au haamini atakayemuachia kiti cha Urais kama atakubali mswada huu upitishwe kama ilivyokuwa kwa awamu zilizopita.

Lakini pia naamini kamwe Wapinzani wasingekubali kukaa chini kukubali kuujadili ule mswada na kuupitisha kwa sababu ndani ya mswada ule kuna majibu ya mambo mengi ambayo Wapinzani wanasema CCM wamefeli na wao wakiingia madarakani watafanya.

Kwa sababu serikali haikutaka kushirikisha wananchi, walichokifanya wapinzani kimeonekana ni kitendo cha kishujaa na uzalendo wa hali ya juu.
Najua wengi hamjapata muda wa kusoma Mswada wa Mafuta na Gesi, vifuatavyo ni baadhi ya vipengele vya mswada huo nimevikopi bila kuongeza neno ili muangalie kama mswada ni mzuri au mbaya na kwa nini uharaka wenye mashaka.

8.-(1) Tanzania Petroleum Development Corporation shall be the  National Oil Company and shall, in that respect, undertake Tanzania’s  commercial aspects of petroleum in the upstream, midstream and downstream operations and participating interests of the Government in the petroleum and natural gas agreements.

 (2) The Government shall at all times maintain a minimum of fifty one  percent of shares in the National Oil Company

 45.-(1) The petroleum operations rights shall be granted to the National Oil Company.

       (2) The National Oil Company shall have exclusive right over all  petroleum rights granted under this Part.

        (3) The licence granted to the National Oil Company shall not be transferable to any other person.

         (4) A company wishing to carry out petroleum operations in Tanzania outside the scope of a reconnaissance permit shall do so together with the  National Oil Company.

92.-(1) PURA may, with a written approval of the Minister, make available to the public-

 (a) details of all agreements, licences, permits and any amendments to the licences, permits     or agreements whether valid or terminated;

 (b)details of exemptions, variations or suspensions of conditions of licence and permit;

98. -(1) The licence holder and contractor shall have obligation to satisfy domestic market in Tanzania from their proportional share of production.

 99. The domestic natural gas price shall be determined based on the strategic nature of the project to be undertaken by the Government

 114.-(1) Subject to this Act, the licence holder and contractor shall pay royalty to the Government in respect of gross volume on petroleum recovered at the delivery point in a manner specified in the Second Schedule. (kwa mujibu wa jedwali lililopo nyuma ya sheria hii, serikali itapaswa kulipwa royalty ya asilimia 7.5 na 12.5)

(2) The agreement in respect to the grant of rights may include a  provision for payment of royalty in kind.

 149. All gas processing facilities shall be located onshore.

 220.-(1) A licence holder, contractors and subcontractors shall give  preference to goods which are produced or available in Tanzania and services which are rendered by Tanzanian citizens and or Local Companies.

(2) Where goods and services required by the contactor or licence holder are not available in Tanzania, such goods shall be provided by a company which has entered into a joint venture with a local company.

 221.-(1) A licence holder and a contractor shall, within twelve months after the grant of each licence, and on each subsequent anniversary of that grant, submit to PURA for approval, a detailed programme for recruitment and training of Tanzanians in accordance with an approved local content plan.

(2) The programme shall provide training and recruitment of Tanzanians in all phases of petroleum operations and gas activities and take into account gender, equity, persons with disabilities, host communities and succession plan in accordance with the Employment and Labour Relation Act.

 223.-(1) A licence holder and a contractor shall on annual basis, prepare a credible corporate social responsibility plan jointly agreed by the relevant local government authority or local government authorities.
